Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding contract between you ("User") and NeedTo.Host ("we", "our"), governing your access and use of the NeedTo.Host platform, including all hosted services, APIs, and associated software.

By creating an account or accessing any part of the platform, you confirm that you are at least 16 years old and have the legal capacity to enter into this contract.

2. Description of Services

NeedTo.Host provides managed cloud hosting infrastructure, including:

• Discord Bot Hosting: Isolated Docker containers for running Discord bots on servers located in France and Europe
• Web Hosting: Containerized web server environments including WordPress hosting
• VPS Containers: General-purpose Docker containers with custom startup commands, hosted on Hetzner servers (Frankfurt, Germany)

Services are provided on a monthly subscription basis or through a free tier subject to resource limitations. We reserve the right to modify, extend, or discontinue features with reasonable notice.

3. Account Terms

You agree to the following obligations regarding your account:

• One account per person. Creating multiple accounts to circumvent free tier limits or other restrictions is prohibited.
• Credential security. You are responsible for keeping your password and credentials confidential. You are responsible for any activity under your account.
• Accurate information. You must provide a valid email address and accurate information during registration. Inaccurate information may result in account termination.
• Immediate notification of suspected unauthorized access to your account: admin@needto.host.

4. Acceptable Use

You may use NeedTo.Host services only for lawful purposes. The following activities are strictly prohibited:

• Illegal content: Hosting, transmitting, or storing any content contrary to applicable law, including French law and European regulations
• Abuse and harassment: Using our platform to harass, threaten, or harm others, including through spam bots or automated messaging campaigns
• Cryptocurrency mining: Running any cryptocurrency mining software, including Monero, Bitcoin, Ethereum, or any other blockchain-related proof-of-work computation
• Spam and unsolicited messages: Operating spam bots, mass mailings, or any tool designed to send unsolicited communications at scale
• Network attacks: Conducting DDoS attacks, port scans, brute force attacks, or any other network abuse from our infrastructure
• Phishing and fraud: Hosting phishing pages, fraudulent sites, or any content designed to deceive users
• Copyright infringement: Hosting or distributing content that infringes on third-party intellectual property rights
• Resource abuse: Artificially consuming resources beyond your allocation, including attempts to circumvent CPU limitations

Violations may result in immediate suspension without refund.

5. Payment Terms

Paid plans are billed monthly in advance. Payments are processed by Stripe, Inc. All prices are shown in euros (EUR), including applicable VAT.

• No refund for time used. We will not issue refunds for partial billing periods when the service has been actively used. In case of suspension for terms violation, no refund will be granted.
• Payment failure: In case of payment failure, your services may be suspended. You will receive email notification and a grace period to update your payment details.
• Termination: You may cancel your subscription at any time from the dashboard. Service remains active until the end of the current billing period.
• Right of withdrawal: Under Article L.221-28 of the Consumer Code, the 14-day withdrawal right does not apply to digital services whose execution has begun with your express consent before the deadline expires.

6. Free Tier

The free tier is provided "as is" without service level guarantees. Free services:

• Use a runtime credit system — active time is deducted from your available balance
• Enter sleep mode after 15 minutes of inactivity
• Are suspended when runtime credits reach zero
• Are permanently deleted 72 hours after suspension without renewal
• Do not include automatic restart, custom domains, or availability guarantees

7. Service Level

We target 99.9% monthly availability on paid plans, measured as container availability outside of scheduled maintenance. This target is provided on a best-effort basis and does not constitute a contractual SLA unless otherwise agreed in writing.

No availability guarantee is provided for free tier services.

We are not responsible for outages caused by: (a) your code or configuration; (b) third-party services including the Discord API; (c) force majeure events; (d) scheduled maintenance with notice.

8. Termination

We may suspend or terminate your account, with or without notice, if:

• You breach any provision of these Terms
• We receive a valid legal request from a competent authority
• Your use poses a security risk to our infrastructure or other users
• Payment obligations remain unmet beyond the grace period

You may terminate your account at any time. Upon termination, all your data will be permanently deleted within 30 days, except for billing data required by law.

9. Limitation of Liability

To the extent permitted by applicable law:

• NeedTo.Host is provided "as is" without any warranty of any kind, express or implied
• We will not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business arising from the use of our services
• Our total liability to you for any claim will not exceed the amount paid by you during the three months preceding the claim

Nothing in these Terms excludes liability for death, personal injury, or fraud resulting from our negligence under French law.

10. Intellectual Property

You retain ownership of all content and code you deploy on NeedTo.Host. You grant us a limited, non-exclusive license to host and operate your content solely for the purpose of providing the service.

All NeedTo.Host platform code, branding, and documentation are our intellectual property. You may not reproduce, copy, or redistribute them without written authorization.

11. Governing Law and Jurisdiction

These Terms are governed by French law. In case of dispute, and absent amicable resolution, the competent courts shall be those of the registered office of NeedTo.Host, unless mandatory consumer protection provisions of your country of residence apply.

For consumer disputes, you may also use mediation via the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

12. Changes to Terms

We may update these Terms periodically. We will notify registered users by email of material changes at least 14 days before they take effect. Continued use of the service after changes constitutes acceptance of the updated Terms.
